Similarly, only 15% of consumers purchase online from another EU country, while roughly three times as many (44%) do so from their own country. The <strong>European Commission<\/strong> argues that the main obstacle for consumers to buy goods online from other EU countries is legal fragmentation in the area of contract law, which also results in high costs for businesses.<\/p>\n<p>Therefore the European Commission has taken initiative to what they call \u201ctackle the main obstacles to cross-border e-commerce in the EU\u201d and to better protect consumers who shop online across the EU as well as to help businesses expand their online sales.<br \/>\nOne of the Proposals of the Directive regulates \u201ccertain aspects concerning contracts for the online and other distance sales of goods\u201d and thus will only be applicable for goods bought online and NOT for services, nor for goods bought in a physical shop.<\/p>\n<p>The Directive will adapt the Directive 1999\/44\/EC regarding the burden of proof and legal guarantees in case of non-conformity of the goods. According to the Proposal, any lack of conformity with the contract which becomes apparent within two years, starting from the moment of the delivery (or \u201cwhen the consumer had physical possession)\u201d, is presumed to have existed at the time of delivery. Exemption is made for defects which are incompatible with the nature of the goods or with the lack of conformity, which the seller will have to proof.<\/p>\n<p>A reversal of the burden of proof is thus installed which implies that during the first two years the consumer will not have to proof that the defect existed at the time of delivery. For example: If a consumer buys a washing machine through an online-shop and this machine is defect during the first two years, he\/she will benefit from a reversal of the burden of proof during the first 2 years and the seller will have to proof that the defect is incompatible with the nature of the goods or with the lack of conformity. The seller will then have to replace or repair the good within a \u201creasonable time\u201d and the consumer will have the right to ask for a price reduction. As a last resort the consumer will also be able to terminate the contract in case the lack of conformity is not\/cannot be remedied through repair or replacement.<\/p>\n<p>If the same consumer buys this very same washing machine in the physical shop of the brand, he\/she will not benefit from the reversal of the burden of proof and the rules of Directive 1999\/44 will still apply whereby the consumer (in most EU-countries) only has 6 months after the delivery to give notice of a non-conformity. After 6 months, the consumer will (in most EU-countries) have to proof that the problem already existed at the time of the delivery.<br \/>\nUnsurprisingly, these provisions meet a lot of resistance of the EU Member States.
